For some very straightforward matters (e.g. simple incorporation), I charge a flat fee amount, however I typically bill by the hour, plus HST & disbursements. My hourly rate is competitive with other business lawyers in the Waterloo Region. Where the conventional billable hour formula may not be appropriate for a matter, I am open to working out a customized fee and billing arrangement in advance.
I do not bill for routine copying, faxing or long distance (within Canada) telephone charges. If a file requires a significant volume of copying, I will charge for the copying at competitive commercial copying rates. I do bill as disbursements my actual out-of-pocket third party expenses, such as government filing and registration fees, search fees and related agency fees.
I typically bill on a monthly basis, with interest payable (in accordance with the Solicitor’s Act) on accounts that have not been paid within 30 days of the billing date. I review every bill before it is sent out to ensure it is fair and reasonable based on the nature and complexity of the matter, the expertise required, the amount of time spent, etc., and in return I expect the courtesy of prompt payment unless special payment arrangements have been agreed to in advance. For new clients, I typically ask for payment of a reasonable retainer upfront (to be held in my trust account and applied towards payment of the client’s account).
